Overview of Arizona Telemarketing Bond Requirements

To become registered as a telephone solicitor in the state of Arizona, you must apply with the Secretary of State, and submit a $100,000 telemarketing bond.

The bond is intended to guarantee that in performing telemarketing services you will comply with Title 44, Chapter 9, Article 6 of the Arizona Revised Statutes (ARS), also known as the Arizona Telephone Solicitation Law. If you violate this law and cause financial damages to consumers, they can file a claim against your bond to request compensation.

If a claim is filed against your bond, your surety will reimburse claimants in an amount that can be as high as the full bond amount, also known as the penal sum of the bond.

Arizona Telemarketing Bond Cost

The cost of your bond is based on the full amount of your bond. The Secretary of State requires a bond in the amount of $100,000 in order to issue a telephonic seller registration.

When you apply for your bond with a surety, the surety will review your personal credit score primarily. The higher your credit score is, the lower your bond cost will be. Given the amount of this bond which is higher than most, you may also be asked to provide the surety with information such as your personal and business financial statements, or cash verification.

Applicants who have a credit score of 700 FICO or above can expect to get the lowest possible rate which for this bond would be between .75% and 1.5% of the total bond amount.

Claims Against Your Bond

Under the conditions of the Arizona telemarketing bond, a claim against the bond can be filed by consumer if a telemarketer has violated either Title 44, Chapter 9, Article 6 of the Arizona Revised Statutes or has committed an unlawful practice under Title 44, Chapter 10, Article 7 ARS.

Such violations and unlawful practices include fraud, dishonesty, misrepresentation, deception, concealment and any other acts that may lead to financial losses for a consumer.

In the case of such a violation, a consumer may then file a claim against the telemarketer’s bond and request compensation. Such compensation, depending on the type and severity of the violation, may even be as high as the full amount of the bond. Once the surety extends compensation to claimants, the bonded telemarketer must reimburse it in full.

Due to the high amount of this bond, committing a violation and having to deal with a claim is highly undesirable for telemarketers. To avoid such a situation it is therefore always best that you strictly comply with the conditions of your bond.
