Why Do You Need an Earned Wage Access Bond in Kansas?

Kansas treats earned wage access as its own category, separate from lending, but that status comes with real financial responsibility. You determine how much of a consumer's paycheck they've actually earned using payroll data, then advance that amount on a nonrecourse basis, meaning you bear the risk if your calculation is off or a consumer's proceeds go unrepaid. How Do You Renew Your Bond?

  • License term: Your license expires December 31 every year and must be renewed annually.
  • Renewal deadline: File your renewal at least 30 days before expiration.
  • Annual report: A separate annual report covering the prior year's business is due to the commissioner by April 1.
  • Bond continuity: Your bond must stay in place for 2 years even after your registration (license) ends, whether through surrender, revocation, or expiration.

Is earned wage access considered a payday loan in Kansas?

No. Kansas law states directly that earned wage access services provided under the Act are not a loan, other form of credit, or money transmission. This is a distinct regulatory category from payday lending.

Can you require a credit score to determine someone's eligibility?

No. Kansas law prohibits registrants from requiring a credit score to determine a consumer's eligibility for earned wage access services.

Are bank holding companies required to register?

No. Certain bank holding companies, depository institutions, and subsidiaries that directly own 25% or more of a bank holding company's or depository institution's common stock are exempt from the Act.

Can you pursue debt collection if a consumer doesn't repay you?

No. Kansas requires earned wage access to be provided on a nonrecourse basis. You can't sue a consumer, use a third-party collector, sell the debt, use outbound calls to collect, or report a missed repayment to a credit bureau.

Can a consumer cancel your service at any time?

Yes. Kansas requires you to let consumers cancel earned wage access services at any time, and you can't charge a cancellation fee or penalty for doing so.

Does bad credit rule you out from getting bonded?

Can you cancel your bond?

Your bond stays in effect until it's cancelled. Cancellation requires 30 days' written notice to the commissioner, and your surety remains liable for any violations that occurred before the cancellation took effect.

What happens to your bond if your registration ends?

Your bond doesn't end when your registration does. It must stay in place for 2 more years after your registration is surrendered, revoked, or expires, since claims can still arise from your prior conduct.
